These terms and conditions ("Consumer Terms and Conditions") apply to your use of this website ("Website"), and your purchase of Products from Cordis, Auckland through this Website, over the telephone and in person at Cordis Auckland’s premises (as applicable).
This Website is managed by SK Chase Limited ("SK Chase"), who acts as an agent for Great Eagle Hotels (Auckland) Ltd trading as Cordis, Auckland (“Cordis, Auckland” “we”, “us” or “our”). SK Chase is a company incorporated in Scotland (No SC253912) with its registered office at 31 Palmerston Place, Edinburgh, EH12 5AP. Cordis, Auckland’s website has separate terms and conditions which apply to the use of that website.
Before placing an order on this Website, you will be asked to agree and to be legally bound by these Consumer Terms and Conditions. Please read them carefully before you submit your order. If you do not accept these Consumer Terms and Conditions, you will not be able to order any Products from us.
We and/or SK Chase reserve the right to vary these Consumer Terms and Conditions from time to time. We recommend that you check these Consumer Terms and Conditions regularly. If these Consumer Terms and Conditions are revised as they apply to your order, we will contact you to give you reasonable advance notice of the changes and to let you know how to cancel the order if you are not happy with the changes.
As a consumer, you may have rights under the Consumer Guarantees Act 1993 (“CGA”) and the Fair Trading Act 1986 (“FTA”). These Consumer Terms and Conditions do not exclude, limit or modify any of your rights under the CGA and the FTA. - Orders and Payment
1.1 Cordis, Auckland offers various products and gift vouchers (“Gift Vouchers”) for sale (together, the “Products”) through this Website, over the telephone or in person at Cordis Auckland’s premises.
1.2 If you order Products using the online order process available on this Website or over the telephone, no contract for the sale of any Products will subsist between you and Cordis, Auckland unless and until Cordis, Auckland accepts your order by way of an email (issued by SK Chase) detailing that payment has been received in full, the Product(s) purchased and confirming your details (the "Confirmation"). That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time SK Chase (on behalf of Cordis, Auckland) sends the Confirmation to you. The Confirmation amounts to an acceptance by Cordis, Auckland of your offer to buy the Product(s) from Cordis, Auckland or a third party supplier that is engaged by Cordis, Auckland.
1.3 You must check that the details of the Confirmation are correct as soon as possible and you should print out and keep a copy of it.
1.4 If purchasing Products:
(a) through this Website, payment shall be taken by credit or debit card. You can make payments with the following cards: Mastercard, Visa, American Express, Diners. Payment shall be taken on our behalf by SK Chase as agent for us by credit or debit card. You can make payments with the following cards: Mastercard, Visa, Delta, American Express, Switch or Solo). Please note that any payments deducted by SK Chase from your account, or refunded back to you will appear on your statement as being from SK Chase.
(b) over the telephone, you will be asked for your email address to receive a weblink from Cordis, Auckland for you to enter your card data. By submitting your payment details, you will be deemed to have accepted these Consumer Terms and Conditions. Payment shall be processed by a staff member of Cordis, Auckland services team once receipt of credit or debit card details are received. No payment information is able to be taken over the phone.
(c) in person from Cordis, Auckland’s premises, you can make payment by cash or EFTPOS machine and you shall receive a receipt from Cordis. Cordis, Auckland reserves the right to charge an additional surcharge for payments by credit card taken on-site.
1.5 You undertake that all details you provide to Cordis, Auckland and SK Chase for the purpose of ordering any Products are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the Products ordered.
1.6 In order to protect your details during ordering, this Website uses a software package known as Secured Sockets Layer (SSL).
1.7 Unless specified otherwise, all the prices for the Products include GST. Please note that postage and packaging charges are not included in the price of the Products. Any postage and packaging charges which apply are advised to you during the check-out and ordering process before you confirm your order.
1.8 Cordis, Auckland reserves the right to amend the price of any Product at any time (including if any price incorrectly recorded on this Website). We will use all reasonable efforts and will take all reasonable care to ensure the Products available for purchase are accurately priced. However, if the price for a Product is incorrect due to a typographical error or error in pricing information, Cordis, Auckland will have the right to cancel any undelivered orders placed for Products listed at the incorrect Price, regardless of whether or not the order has been confirmed or payment has been received. If the order is cancelled and payment has been received, Cordis, Auckland will refund that payment.
1.9 All descriptions of Products, specifications, quantities and prices of Products depicted on the Website are subject to change at any time without notice. Certain weights, measurements and similar descriptions are approximate and provided for convenience purposes only.
1.10 We will make all reasonable efforts to accurately display the attributes of the Products, including applicable colours. However, the actual colour you see will depend on your computer and we cannot guarantee your computer will accurately display such colours.
- Delivery, Title and Risk
2.1 Following the Confirmation of your order, Cordis, Auckland may inform you of an estimated Delivery Date for the Products. The Delivery Date is an estimate only. Provided full payment of the order for the Products has been received, Cordis, Auckland will use reasonable endeavours to deliver the Products by the Delivery Date. Cordis, Auckland will not, under any circumstances (whether in contract, tort or otherwise), be liable for delivering the Products after the Delivery Date.
2.2 The following delivery options are available to customers ordering Products in New Zealand (as applicable and where available for that Product):
- Email (Where Available): In relation to Gift Vouchers, an automatic email with a Gift Voucher link will be sent as soon as the transaction is completed. This can be sent to either the purchaser or the recipient. This is a system generated email and therefore may go to the email recipient's junk or spam email folder. Please also take care when entering the email address that it is correct. If an email delivery fails, SK Chase will attempt to contact you to advise that the email has been returned to them 'undelivered', and will try to get another email address.
If you have difficulty opening your Gift Voucher link, copy the Gift Voucher link text by highlighting, then right click and select 'Copy'. Open your internet browser and paste the Gift Voucher link into your address bar by right clicking and select 'Paste'. Print the Gift Voucher.

Post (Where Available) delivered by New Zealand Post: Standard Post – Letter (untracked): Please then allow three to ten (3-10) working days (delivery deadline) for the Gift Voucher to be delivered by New Zealand Post. Delivery to and from rural and remote areas may take longer. Please note that delivery targets are a guide only and New Zealand Post does not guarantee delivery within the above timescales.
NZ CourierPost (tracked): Please then allow two to five (2 to 5) working days (delivery deadline) for the Products to be delivered by New Zealand Post. Delivery to and from rural and remote areas may take longer. Please note that delivery targets are a guide only and neither New Zealand CourierPost nor Cordis, Auckland can guarantee delivery within the above timescale.
Poste Haste Courier (tracked): Please then allow at least two to five (2 to 5) (delivery deadline) for the Gift Voucher to be delivered by Poste Haste. Delivery to and from rural and remote areas may take longer. A physical address must be provided. Please note that delivery targets are a guide only and neither Poste Haste nor Cordis, Auckland can guarantee delivery within the above timescales.
Deadline Courier (tracked): Please then allow at least two to three (2 to 3) working days (delivery deadline) for the Products to be delivered by Deadline Courier. Delivery to and from rural and remote areas may take longer. A physical address must be provided. Please note that delivery targets are a guide only and neither Deadline Courier nor Cordis, Auckland can guarantee delivery within the above timescales.
Collection in person from Cordis, Auckland hotel: Please contact Cordis, Auckland to arrange for the collection of your Vouchers/Products. Door to Door Delivery (Cordis Dream Bed Products Only): Cordis Dream Bed Products are delivered door to door by the Manufacturer. All Products are manufactured to order and the production lead time will vary from time to time depending on circumstances. The production availability date can only be confirmed once the order has been paid for and placed with the Manufacturer. Any delivery access issues for the delivery trucks should be advised when placing orders. Should you not receive your item or wish to contact Cordis, Auckland at any stage, please email The Shop team at firstname.lastname@example.org.
2.3 The following delivery supplements will apply to your Products:

- Standard Post Letter, Room/Dining Vouchers Only (untracked) - $0.00
- Deadline Couriers, Chuan Spa Vouchers (2 to 3 days, tracked) - $18
- Deadline Couriers, Chuan Spa Products (2 to 3 days, tracked) - $25
- NZ CourierPost, The Shop Products (2 to 5 days, tracked) - $25
- Post Haste Couriers, Room/Dining Vouchers Only (2 to 5 days, tracked) - $10
- Door to Door (Freighted by Manufacturer), Cordis Dream Bed Products Only - $100
Please note that Products cannot be delivered overseas, and fees for delivery may be amended from time to time to reflect fee changes imposed by the relevant carrier.
2.4 Title in the Products will not pass to you until payment has been received in full by us or our agent. Possession and risk in the Products passes to you upon delivery of the Products to your agent or carrier or upon delivery of the Products to the address supplied by you when placing an order.
- Terms and Conditions of Gift Vouchers
3.1 In respect of each Gift Voucher sold, this clause 3 of these Consumer Terms and Conditions will apply.
3.2 Each Gift Voucher sold is subject to terms and conditions of use which can be viewed on this Website alongside each individual Gift Voucher which shall apply in addition to the terms in these Consumer Terms and Conditions.
3.3 Once your order has been processed by SK Chase (on our behalf):
(a) if you order a Gift Voucher and request that it is emailed to you, SK Chase will issue the Gift Vouchers and email the Gift Vouchers to the email address provided by you; and
(b) if you order a Gift Voucher and request it be mailed to you or you request pick up from Cordis, Auckland’s premises, Cordis, Auckland will issue the Gift Vouchers and will mail/courier the Gift Voucher to the address provided by you or make the Gift Voucher available for collection from Cordis, Auckland’s premises, and performing any other terms set out in the Confirmation.
3.4 Please remember that, in addition to the terms included in these Consumer Terms and Conditions, the terms and conditions which will apply to each Gift Voucher will be individual to each Gift Voucher and can be viewed on this Website alongside each individual Gift Voucher.
3.5 You may cancel your original Gift Voucher order and request for a new Gift Voucher to be issued (in which case the original Gift Voucher will be cancelled) or seek a refund if:
- you (or the intended recipient) have not received your Gift Voucher order after placing a Gift Voucher order where your chosen delivery method is by email; or
- the Gift Voucher gets lost in the post.
To cancel your order, please contact Cordis, Auckland at email@example.com for accommodation and dining Gift Vouchers, and firstname.lastname@example.org for spa Gift Vouchers.
If you do choose to cancel your Gift Voucher order under this clause 3.5 and you have ordered more than one Gift Voucher, you can cancel in respect of one Gift Voucher or all of the Gift Vouchers, unless splitting them up would significantly reduce their value.
After you cancel your order Cordis, Auckland will arrange a refund of any sums you have paid for the cancelled Gift Voucher and its delivery (if a postal delivery option was chosen).
3.6 Cordis, Auckland can cancel your Gift Voucher without notice if necessary to comply with a court order, or if we reasonably form the view that the Gift Voucher has been stolen or compromised, or is being used fraudulently or for other criminal activity, or that you are not the rightful holder of the Gift Voucher.
3.7 All specific arrangements regarding booking dates and times must be made directly with Cordis, Auckland, and you should reconfirm any arrangements made with Cordis, Auckland a few days before the event to avoid disappointment. Cordis, Auckland will use all reasonable endeavours to meet your request but cannot guarantee any specific date or time.
If you have already received the Gift Voucher which you have cancelled, you should destroy it. If Cordis, Auckland finds, after it has received your notice of cancellation, that the Gift Voucher has been used you shall not be entitled to a refund.
3.8 Except for refunds issued pursuant to clause 5 and to the extent permitted by law, Gift Vouchers cannot be exchanged, refunded or redeemed for cash.
3.9 You must not on-sell your Gift Voucher. If you have been given the Gift Voucher as a gift, you can use the Gift Voucher in accordance with these Consumer Terms and Conditions, and your use of the Gift Voucher indicates your acceptance of these Consumer Terms and Conditions. As the user of the Gift Voucher, you cannot assign any of your rights and obligations under these Consumer Terms and Conditions.
3.10 Cordis, Auckland agrees to provide or procure the provision of the services for which the Gift Voucher was purchased in accordance with the description on this Website and the Cordis, Auckland website (if applicable), at all times with reasonable skill and care.

- Liability, Warranties and Product Returns
5.1 Subject to clause 3.10 and 5.4, to the fullest extent permitted by law, except as expressly set out in these Consumer Terms and Conditions, Cordis, Auckland excludes all warranties, representations or guarantees (whether express, implied or statutory) in relation to any Products you purchase, including any warranty of fitness for any particular purpose or warranty of merchantability.
5.2 Subject to clauses 3.5, 5.4 and 5.5 and to the extent permitted by law, the liability of Cordis, Auckland, SK Chase and any third parties engaged by them, and as your sole and exclusive remedy, is limited to replacing faulty Products or refunding the cost of the Product (at Cordis, Auckland’s sole discretion). Neither Cordis, Auckland nor SK Chase will be liable to you for breach of these Consumer Terms and Conditions or any consequential loss or damage, including but not limited to, any liability in connection with any goods or services purchased by the redemption of your Gift Voucher.
5.3 You agree that you will at all times comply fully with all relevant laws, ordinances, rules, regulations and orders of all relevant regulatory bodies in relation to any of the products, services or information made available to you through this Website.
5.4 Nothing in these Consumer Terms and Conditions is intended to limit or replace any rights you have under the CGA or the FTA, provided that if you are acquiring the Products in trade the provisions of the CGA and sections 9, 12A, 13 and 14(1) of the FTA will not apply to the supply of the Products to you.
5.5 Subject to clause 5.4 and to the fullest extent permitted by law, Cordis, Auckland will not accept Products for return (but excluding Gift Vouchers) unless:
(a) they have been damaged during delivery, were not received by you in full working order, have been double-delivered or mistakenly supplied; and
(b) the Products are returned to Cordis, Auckland, correctly packaged in their original carton, within 14 days of receipt by you.
The Website is protected by copyright, and other intellectual property rights and laws. We or SK Chase are the owner or the licensee of all copyright, trademarks, design rights, patents and other intellectual property rights on this Website, and the material published on it. You may view this Website and download part(s) of it to a personal computer for personal viewing for private purpose, but for no other purpose whatsoever. NONE OF THE CONTENT MAY BE DOWNLOADED, COPIED, REPRODUCED, TRANSMITTED, STORED, SOLD OR DISTRIBUTED FOR ANY NON PERSONAL PURPOSE WITHOUT OUR PRIOR WRITTEN CONSENT.
By accessing and using this Website, or any of the information on it, you acknowledge that, while reasonable endeavours have been used to ensure that all information contained on this Website is correct, accurate and up to date, neither SK Chase nor Cordis, Auckland make any warranties, representations or undertakings that the material on this Website is accurate, up to date or will be free from infections, viruses, worms, trojan horses and/or other codes that have contaminating or destructive properties. - Governing Law and Jurisdiction
The Website and these Consumer Terms and Conditions are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts in all matters relating to such use of this Website and in relation to these Consumer Terms and Conditions. If any provision of these Consumer Terms and Conditions is found by a court of competent jurisdiction to be invalid you agree that the other provisions of these Consumer Terms and Conditions will remain in full force and effect in so far as possible. If you access this Website from outside the New Zealand you are responsible for compliance with any local laws relating to access.
